Well that is fair reasoning. I got my suspension for ToS stuff I didn't violate. They are much stricter about copyright and I didn't get my channel back. I doubt he will either...

You are living in a dream world, everything is automated and you never get your account back after you've lost it. You've also glossed over the fact you don't own any of the content on your channel.
 
I understand...theoretically of course, you are right. Things are changing, however, and in my case, this claiments could have EASILY blocked my audio or muted it as now, everyone else is doing.... And he is not one of the BIG guys(eg. Warner music, mug etc) . No I checked this little record producer out ...(not to mention his company is currently listed as not being able to pay his creditors) Yes you are right in what you say ...but I sense this plaintiff is an angry and envious group of nobodies ( you should see his pathetic you tube sight) what gets me p****d off the most is that I wrote to them and practically and humbly pleaded with him for a retraction.... No response INDEED!!! We shall see what happens ...thanks

It doesn't matter who they are. You violated copyright laws, and your channel deserves the suspension. Sorry but you will never get it back. Also it was probally autoclaimed. They will probally be confused when they read your email...
 
There might be a way with the new version of the YouTube API, but I think you may need access to the account though. I'll have a read and find out.
 
I have no idea how you are claiming this as fair use. Unless you were doing an actual report or story on each performer (i assume your new channel is a continuation of your old one) and just featured a bit of video as reference. That's the only way I can think that what you're doing could be classified as fair use.

Fair use is not taking the original and just reposting it or mashing it with other pieces of work that is not yours.
