Michelle Phan counter-sues

Good for her, especially if she had the permission to use the music, then they call her out and make her look bad for 'illegally' using their music when she was promoting it for them!
 
I still personally doubt she does have the licenses :P

Companies can be un-smart at times but sueing a person with a massive fan-base for not having permission if she did would be really, really un-smart..

But with that large of an audience, don't you think that would be un-smart of Michelle to use copyrighted music without permission.
Either way, someone is being un-smart in this situation.

  1. Her audience was much smaller when she first started using the music
  2. licenses for popular artists/tracks tend to be in the thousands of dollars region for each use.
 
It seems to me that she would have a good case that the music label is acting in bad faith.
Have to wonder what reason they would have to do so though.

It wouldn't take a genius to predict what her actions would be if they did so.
