Copyright ID claim?

So i have just recieved a copyright id claim on my newest video. It says third party content matched. I have used a video from Blizzard which is an actual in game quest. The full video is around 16-17 minutes and i have cut it in parts and just the video put around 1:30 in my video.

I think it falls under fair use and i have disputed it, since i even have a voice over it. But i was wondering how would that affect my account, would i just not be able to monetize it or can i lose my partnership or get banned in the future even if i acknowledge it?
 
If you acknowledge it I'm not sure what precautions follow since you tried to dispute it already. You used a video made by Blizzard without their permission, this doesn't actually fall under fair use as you didn't record the gameplay footage yourself, this is probably the equivalent of a death sentance in YouTube, a large reason being that it's Blizzard and they love protecting their IPs at almost any cost, meaning they could literally destroy you if they felt like it. Only thing you can do is try to gain permission from them by contacting them directly or wait it out and see what happens. If it was fair use, then people would no longer record their own gameplay footage, they would just steal everyone elses without permission. Also, the commentary won't help as the gameplay would match the video you took it from anyways, as it would be identical.
 
No but i mean they did say in their policy that you can use their trailers and such under fair use. I have asked already on the blizzard forums. If i just acknowledge the claim afterwards does it just mean i can't monetize it or can it scar my account?

If you acknowledge it, the video will be monetized but Blizzard get all the money that the video makes. You will not get any copyright strikes if you acknowledge it, at least from what I recall. Also in future, use emails so you can get a written reply for safe keeping. And also they allowed fair use, not commercial use lol keep in mind the 2 are very different.
 
Yes but it did also say that you can you can use it if you have ayt or justin.tv partnership for commercial purposes.

Basically what they are saying is that you can't use footage from their trailers lol. If I were you, I would just acknowledge it and hope Blizzard don't take further action or better yet, just remove monetisation altoghether to be safe. Just keep in mind, once you do remove monetisation, you may not be able to monetise it again if you do get further permission later on. I myself am in the middle of waiting for YouTube to send me the option to give over an email I got from EA stating they allow monetisation and production using their assets. I really should join a network but cbf looking for 1 that suits me -.-

I think so. That you'd need to look into more though. I'm unsure of what happens once the dispute process has begun, does it give you the option to stop it? I also think the strike would only be applied if the dispute was unsuccessful on your behalf. I've heard it can also take months before anything gets done. In theory yes but again you'd have to look that 1 up. Usually if I get a content claim I check what it is and remove the video if it's a claim from a valid copyright holder. I would never dispute without full permission or unless it wasn't a valid copyright holder.
