help me understand

Iv just watched a 3 min clip on youtube a snippet from Micheal McIntyre and before i could watch an advert came on now what i don't understand it looked like someone recorded the clip off a dvd or tv how or why has this video got adverts i thought you needed permission from the rights holder? It doesn't look like this person has am i missing something?

It depends. If it can't be considered as fair use (commentary, criticism, critiquing, parody, etc), then he has no permission to even upload it, muchless put ads next to it. And I doubt (though it can happen) that the company or person who made it/is in it has claimed the video for putting ads next to it and such. Happens everyday, though. The only way you have permission for stuff like that is by either contacting the people who made it/are in it or by fair use.
 
I see. So your saying a video can be uploaded and get ads and payment but there's always a risk that the copyright holder can have it taken down in a heartbeat. The videos I watch have been on for years. I'm thinking of making a video of a dvd box set of the best bits or funny bits but I want ads I want a few quid now and again. Thanks guys.
 
There's not really a "fair use for five-year-olds" type of thing I've found so far, because a lot of it is decided individually on a case-by-case basis in a court by a judge, but Jane Friedman has a great article (that I can't link to). What you're talking about doing is NOT fair use. It essentially has to be used for not-for-profit purposes, i.e. the fact that ads are running (especially since you've just stated specifically that you want money for it with no intent of satirical, parody, or education purpose) automatically disqualifies it.

Interesting! This may be why there's not a fair use for five-year-olds. Thank you for the correction.
