So Can I Record Wiiu gameplay without getting Flagged?

Okay SO i got offered a really good deal on a wiiu so i love it but can i record and upload footage without getting flagged i know nintendo is strict my friend edited a video for me and he put mario n64 music as backround music and it gett flagged.

Just do the other games, the NON-Nintendo games, you know, avoid Mario and Zelda like the plague.... which is kinda tough since lately these newer Nintendo systems have almost all Nintendo stuff and the occasional third party game.
