Did I need consent?

So basically I made a video called reacting to old instagram photos. and it's been up for a while and it's been fine but there's this one picture that is with two of my old friends and one of them found it and commented "I didn't sign a consent form what is this?" but it's been on Instagram which is public for a really long time which is where I start to think he doesn't really need a consent form. I could always trim it out of the video to avoid a problem but if I don't have to then I don't want to. I don't know if I'm allowed to link videos here cause it may be considered promotion but if you look on my channel, you'll see it. Let me know what you guys recommend. I could always trim it out of the video like I said but then isn't there no undoing it? So, that's why I'd rather know for sure if I should or not. Thanks guys! :)
 
Under the Fair Use Act, you don't have to get signed consent for the way you are using it. That's why the Fine Bros can get away with showing such famous videos and music without getting in trouble.

Because what you are doing is listed under "Commentary/ Criticism" you don't have to. But it would be the decent thing to do that if someone doesn't like being in a video, then you should cut them out. I mean, how would you feel in their situation?

If he files privacy infringement complain your video may be removed by YouTube staff. This may or may not result in community strike. Please check this information:

If that does happen, I think you can repeal it on the youtube system. But then it takes ages for the staff to actually get around to it. Better to not test the system and stay on peoples good side on my opinion :)
 
But like I was looking it over and it says the individual has to be uniquely identifiable. If he does file a complaint, it says YouTube will let me know about it and give me 48 hours to take action and if that happens, yeah absolutely I'll edit it out it's not worth all the trouble. But thanks for your help guys! :)
